Find below the Prefectorial Order of 02 June 2020, concerning the regulation of ships and maritime activities.
PREFECTORAL DECREE N° 104/2020 REGULATING THE NAVIGATION OF SHIPS AND MARITIME ACTIVITIES IN THE FRENCH INTERNAL AND TERRITORIAL WATERS OF THE MEDITERRANEAN TO FACE THE CORONAVIRUS 2019 EPIDEMIC (COVID-19).
List of articles of the decree of 02 June 2020:
ARTICLE 1 This Order applies from 2 June to 15 June 2020, inclusive, in the French internal and territorial waters of the Mediterranean as well as on the water bodies of lagoons and salt ponds in the public maritime domain.
ARTICLE 2 At the beaches prohibited to the public by the Prefect of the Department, in application of the provisions of Article 46 of Decree n° 2020-663 of 31 May 2020, the stopping and mooring of pleasure craft and the launching of boats and watercraft from these same vessels are prohibited in a 300 metre coastal strip.
The restrictions on stopping and mooring of pleasure craft are not applicable in the event of risks to persons or maritime safety.
ARTICLE 3 The entry into French territorial or internal waters of a foreign-flagged pleasure craft from a foreign port is prohibited, if the destination of this craft is a port, stop or anchorage located on the French coastline. This prohibition does not apply to foreign-flagged pleasure craft transiting in accordance with the rules of innocent passage in French territorial waters.
This prohibition does not apply to pleasure craft flying the Monegasque flag which are authorised to navigate freely in French territorial waters.
ARTICLE 4 For health reasons, the organisation of nautical events at sea is prohibited.
ARTICLE 5 Infringements of the present Order expose their perpetrators to prosecution and punishment as provided for by articles 131-13 and R. 610-5 of the penal code, by articles L. 5242-2 and L. 5243-6 of the transport code and by articles 6 and 7 of decree n° 2007-1167 of 2nd August 2007 mentioned above.
ARTICLE 6 This Order abrogates Prefectoral Order n°071/2020 of 18 May 2020.
ARTICLE 7 The Departmental Directors of the territories and sea of the Mediterranean maritime coast, the officers and agents empowered in matters of navigation police are responsible, each as far as he or she is concerned, for the execution of the present Order which will be published in the Collection of Administrative Acts of the Mediterranean Maritime Prefecture.
