PREFECTURAL DECREE N° 062/2020 REGULATING THE NAVIGATION OF VESSELS AND MARITIME ACTIVITIES IN FRENCH MEDITERRANEAN INTERNAL AND TERRITORIAL WATERS TO ADDRESS THE 2019 CORONAVIRUS.
List of articles in the Order of 8 May 2020:
- ARTICLE 1: This order applies from Monday 11 May to Sunday 1 June 2020, inclusive, in the French internal and territorial waters of the Mediterranean, as well as in the bodies of water of lagoons and saltwater ponds within the maritime public domain.
- ARTICLE 2: In order to contain the spread of the COVID-19 virus and subject to the powers of mayors under Article L.2213-23 of the General Code of Local Authorities and those of the authority vested with port police powers under Article L.5331-8 of the Transport Code:
- A stop at a port, anchoring, and mooring for pleasure craft flying the French or a foreign flag are limited along the coast to a maximum distance of 54 nautical miles (approximately 100 km) from their home port or mooring buoy. Disembarking passengers ashore must comply ;
- pleasure vessels flying the French or a foreign flag No more than 10 passengers are permitted to board.
- Article 3: Entry into French territorial or internal waters landing from a pleasure craft flying a foreign flag and coming from a foreign port is prohibited, if the destination of this craft is a port or a stopover or anchorage located on the French coast. This prohibition does not apply to pleasure vessels flying a foreign flag transiting under the rules of innocent passage in French territorial waters.
The captain of a pleasure craft flying the French flag, arriving from a foreign port, must, upon entering French territorial waters, declare their health status to the nearest National Navy semaphore. The conditions for this health declaration are specified in Annex I.
- ARTICLE 4: for public health measures, The organisation of waterborne events at sea is prohibited.
- ARTICLE 5: Infractions to this order shall be liable to the penalties and punishments provided for by Articles 131-13 and R. 610-5 of the Penal Code, by Articles L. 5242-2 and L. 5243-6 of the Transport Code and by Articles 6 and 7 of Decree No 2007-1167 of 2 August 2007 as cited above.
- ARTICLE 6: This order repeals and replaces, with effect from Monday 11 May 2020 (00:00), prefectural order no. 054/2020 of 24 April 2020.
- ARTICLE 7: The departmental directors for territories and the sea of the Mediterranean maritime facade, and the authorised officers and agents for navigation police, shall be responsible, each within their own remit, for the implementation of this decree, which shall be published in the collection of administrative acts of the Mediterranean maritime prefecture.
